These Terms of Service (“Terms”) govern your use of the Delta Drift Marine Co. website and services. By requesting service, enrolling in a program, or authorizing vessel access, you agree to these Terms.

Delta Drift Marine Co. (“Delta Drift Marine,” “we,” “our,” or “us”) provides professional, non-mechanical boat and yacht care services throughout the California Delta.

1. Our Service Categories

Delta Drift Marine operates across three service categories. Each has specific scope limitations and expectations.

2. Cleaning & Detailing Services

Scope of Cleaning & Detailing

Cleaning & Detailing services may include:

  • Exterior wash and rinse

  • Light interior wipe-downs

  • Surface cleaning (vinyl, gelcoat, glass, non-skid)

  • Dust, cobweb, and light grime removal

These services are cosmetic and surface-level only.

Cleaning & Detailing Disclaimers

  • Results vary based on vessel condition, age, materials, and exposure

  • We do not guarantee stain removal, oxidation correction, or restoration outcomes

  • Deep restoration, compounding, polishing, or specialty treatments are excluded unless explicitly agreed to in writing

3. The Delta Guardian Program (Subscription Services)

Program Overview

The Delta Guardian Program is a subscription-based preventative care service designed to help maintain vessel readiness while docked.

Guardian visits may include:

  • Visual interior and exterior inspections

  • Light cleaning and debris removal

  • Battery observation and basic readiness checks

  • Engine run-ups when safe, permitted, and applicable

Subscription Terms

  • Subscriptions are billed on a recurring monthly basis

  • Pricing may vary based on vessel length and condition

  • Services are performed on a set cadence, not on-demand or unlimited

Billing Authorization

By enrolling, you authorize Delta Drift Marine to charge your selected payment method automatically.

Failed or disputed payments may result in paused or suspended service until resolved.

Cancellation & Changes

  • Subscriptions may be canceled with notice before the next billing cycle

  • No refunds for services already rendered

  • Program pricing or scope may change with advance notice

4. Maintenance Support Services (Non-Mechanical)

Scope of Maintenance Services

Maintenance Services may include:

  • Visual system checks (batteries, bilge condition, obvious leaks)

  • Fluid level observations (no topping off unless approved)

  • Basic readiness tasks approved in advance

Delta Drift Marine does not provide mechanical, electrical, diagnostic, or repair services.

Maintenance Disclaimers

  • All observations are visual only

  • We do not diagnose issues or guarantee system performance

  • Customers are responsible for engaging licensed professionals for repairs

5. Walkthroughs & Service Eligibility

A walkthrough may be required prior to:

  • Cleaning & Detailing services

  • Delta Guardian enrollment

  • Maintenance Services

Walkthroughs allow us to confirm:

  • Vessel size and condition

  • Service scope and pricing

  • Safety and access requirements

Delta Drift Marine reserves the right to decline or discontinue service due to unsafe conditions, access limitations, or marina restrictions.

6. Marina Access & Authorization

By requesting service, you confirm that:

  • You are authorized to grant access to your vessel

  • Marina management permits third-party service access

  • Slip location and access details provided are accurate

Delta Drift Marine is not responsible for missed or delayed service due to marina rules, lockouts, weather holds, or access issues beyond our control.

7. Customer Responsibilities

You agree to:

  • Provide accurate vessel and access information

  • Maintain a reasonably safe service environment

  • Secure pets, valuables, and personal items

  • Disclose alarms, hazards, or special instructions

Failure to do so may limit or prevent service.

8. Built-In Disclaimers & Limitations of Liability

No Guarantees

Delta Drift Marine does not guarantee:

  • Cosmetic perfection

  • Mechanical reliability

  • Prevention of system failure

  • Protection from weather, moisture, corrosion, or environmental exposure

Pre-Existing Conditions

We are not responsible for:

  • Existing damage, wear, corrosion, or system failure

  • Aging components or deferred maintenance

  • Manufacturer defects or prior repairs

Weather & Environmental Conditions

Services may be delayed, rescheduled, or modified due to weather, tides, or safety concerns.

9. Damage & Claims

If you believe damage occurred due to our service:

  • Notify us within 48 hours of service completion

  • Provide photos and a written description

If liability is established, our responsibility is limited to the cost of the specific service performed.

10. Payments & Refunds

  • All pricing is in U.S. dollars

  • Payments are processed via secure third-party providers

  • Completed services are non-refundable

  • Missed services due to access or customer-related issues are not refundable

11. Service Suspension or Termination

Delta Drift Marine may suspend or terminate services if:

  • Payments fail or are improperly disputed

  • Safety or access concerns arise

  • These Terms are violated

Outstanding balances remain due for services already rendered.

12. Website Use

You agree not to misuse the website, submit false information, or reproduce content without permission. All website content is owned by Delta Drift Marine unless otherwise stated.

13. Changes to These Terms

These Terms may be updated periodically. Continued use of services constitutes acceptance of updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of California.
